Cependant, sans disposition juridique contraignante, ce droit risque de se limiter \u00e0 une p\u00e9tition de principe. Il convient donc, comme le pointe notamment le rapport Mettling, d\u2019en garantir l\u2019effectivit\u00e9 en l\u2019introduisant dans la loi.<\/p>\n<p>* Le groupe BPCE a \u00e9t\u00e9 condamn\u00e9 le 18 d\u00e9cembre dernier par le tribunal de police de Paris \u00e0 317 amendes pour avoir \u00ab enfreint les dispositions du Code du travail sur le temps de repos minimal quotidien ainsi que sur le travail de nuit \u00bb, entre les mois de f\u00e9vrier et de juin 2014.<\/p>\n<ol start=\"3\">\n<li><strong> Encadrer strictement les forfaits jours :<\/strong><\/li>\n<\/ol>\n<p>En 2000, lorsqu\u2019ils se sont mis en place, les forfaits jours devaient permettre la r\u00e9duction du temps de travail des cadres, et n\u2019\u00e9taient destin\u00e9s qu\u2019\u00e0 10 % d\u2019entre eux. Aujourd\u2019hui, c\u2019est tout l\u2019inverse : le nombre de salari\u00e9s au forfait-jours ne cesse d\u2019augmenter (13,5 % des salari\u00e9s et 50 % des cadres) et leur temps de travail explose.
