Vous recevez chaque mois dans votre boite mail un compte-rendu retra\u00e7ant les questions pos\u00e9es \u00e0 la direction.<\/p>\n<p>Cette instance est obligatoire dans les entreprises comptant 11 salari\u00e9s ou plus.<\/p>\n<p>L\u2019objectif de la r\u00e9union est de \u00abpr\u00e9senter \u00e0 l\u2019employeur toutes les r\u00e9clamations individuelles et collectives relatives aux salaires, \u00e0 l\u2019application du Code du travail, concernant la protection sociale, l\u2019hygi\u00e8ne et la s\u00e9curit\u00e9 ainsi que les conventions et accords collectifs de travail applicables \u00e0 l\u2019entreprise\u00bb.<\/p>\n<p>Les \u00e9lus ont la capacit\u00e9 de saisir l\u2019inspection du travail s\u2019ils estiment qu\u2019il y a un manquement. Ils peuvent aussi exercer un droit d\u2019alerte en cas \u00abd\u2019atteinte injustifi\u00e9e aux droits des personnes, \u00e0 leur sant\u00e9 physique ou mentale, ou aux libert\u00e9s individuelles\u00bb et provoquer la saisine directe du bureau de jugement du Conseil des prud\u2019hommes statuant selon la forme des r\u00e9f\u00e9r\u00e9s.<\/p>\n<p>Cette instance est donc celle qui permet aux salari\u00e9s de faire remonter, via leurs \u00e9lus, des questions aupr\u00e8s de la direction.<\/p>\n<p>Dans les faits, en Caisse d\u2019Epargne Midi-Pyr\u00e9n\u00e9es, les r\u00e9ponses aux questions sont r\u00e9dig\u00e9es au pr\u00e9alable par le service RH. Lors de la r\u00e9union, les directeurs commerciaux lisent les r\u00e9ponses et un d\u00e9bat \u00e0 lieu. Ces d\u00e9bats ne sont malheureusement pas consign\u00e9s sur le proc\u00e8s verbal re\u00e7u chaque mois par les salari\u00e9s\u2026<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Le comit\u00e9 d\u2019entreprise<\/strong><\/li>\n<\/ul>\n<p>Le comit\u00e9 d\u2019entreprise est obligatoire dans les entreprises de 50 salari\u00e9s ou plus.<\/p>\n<p>D\u2019apr\u00e8s le code du travail, le comit\u00e9 d\u2019entreprise a pour objet d\u2019assurer une expression collective des salari\u00e9s, permettant la prise en compte permanente de leurs int\u00e9r\u00eats lors des d\u00e9cisions relatives \u00e0 la gestion et \u00e0 l\u2019\u00e9volution \u00e9conomique et financi\u00e8re de l\u2019entreprise, \u00e0 l\u2019organisation du travail, \u00e0 la formation professionnelle et aux techniques de production.<\/p>\n<p>Il formule et examine, \u00e0 la demande de la direction, toute proposition de nature \u00e0 am\u00e9liorer les conditions de travail, d\u2019emploi et de formation professionnelle des salari\u00e9s, ainsi que leurs conditions de vie dans l\u2019entreprise.<\/p>\n<p>Avant toute prise de d\u00e9cision sur un projet (comme le remaillage en CEMP), l\u2019employeur a l\u2019obligation d\u2019effectuer une consultation aupr\u00e8s du comit\u00e9 d\u2019entreprise. Ce comit\u00e9 doit disposer, pour formuler un avis motiv\u00e9, d\u2019informations pr\u00e9cises et \u00e9crites. Le CE n\u2019a aucun pouvoir de blocage. M\u00eame en cas d\u2019avis n\u00e9gatif, l\u2019employeur peut appliquer son projet.<\/p>\n<p>Le second r\u00f4le du comit\u00e9 d\u2019entreprise est d\u2019assurer le contr\u00f4le et la gestion de toutes les activit\u00e9s sociales et culturelles \u00e9tablies dans l\u2019entreprise au b\u00e9n\u00e9fice des salari\u00e9s ou de leur famille (Ch\u00e8ques vacances, locations, subventions, etc\u2026)<\/p>\n<p>L\u2019employeur verse au comit\u00e9 d\u2019entreprise une subvention de fonctionnement d\u2019un montant annuel \u00e9quivalent \u00e0 0,2 % de la masse salariale brute. Ce montant s\u2019ajoute \u00e0 la subvention destin\u00e9e aux activit\u00e9s sociales et culturelles (lorsqu\u2019elle existe car cette derni\u00e8re n\u2019est pas obligatoire\u2026).<\/p>\n<p>En Caisse d\u2019Epargne Midi-Pyr\u00e9n\u00e9es, la CGT est tr\u00e8s pr\u00e9sente au sein du comit\u00e9 d\u2019entreprise. C\u2019est un de nos \u00e9lus qui est secr\u00e9taire de cet organe.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Le CHSCT (comit\u00e9 d\u2019hygi\u00e8ne, s\u00e9curit\u00e9 et conditions de travail)<\/strong><\/li>\n<\/ul>\n<p>Cet organe est obligatoire dans les entreprises de 50 salari\u00e9s ou plus.<\/p>\n<p>Le CHSCT n\u2019est pas uniquement une instance consultative. Il dispose de la capacit\u00e9 d\u2019intervenir de fa\u00e7on concr\u00e8te. C\u2019est pour cela qu\u2019un certain nombre de voix patronales cherchent \u00e0 remettre en cause ses pr\u00e9rogatives. Une fusion entre le CHSCT et le comit\u00e9 d\u2019entreprise arrangerait bien l\u2019employeur\u2026<\/p>\n<p>Selon l\u2019article L 4612-1 du code du travail, le CHSCT a pour mission :<\/p>\n<p>\u2013 de contribuer \u00e0 la protection de la sant\u00e9 physique et mentale et de la s\u00e9curit\u00e9 des salari\u00e9s de l\u2019\u00e9tablissement et de ceux mis \u00e0 sa disposition par une entreprise ext\u00e9rieure ;<br \/>\n\u2013 de contribuer \u00e0 l\u2019am\u00e9lioration des conditions de travail, notamment en vue de faciliter l\u2019acc\u00e8s des femmes \u00e0 tous les emplois et de r\u00e9pondre aux probl\u00e8mes li\u00e9s \u00e0 la maternit\u00e9 ;<br \/>\n\u2013 de veiller \u00e0 l\u2019observation des prescriptions l\u00e9gislatives et r\u00e9glementaires prises en ces mati\u00e8res.<\/p>\n<p>Le CHSCT doit se r\u00e9unir au moins une fois par trimestre. Cela peut \u00eatre plus si la situation l\u2019exige.<\/p>\n<p>Le CHSCT proc\u00e8de \u00e0 des inspections dans l\u2019\u00e9tablissement.
